1. About EpicBDSM
EpicBDSM is an independent creative project and online platform dedicated to AI-generated video content exploring BDSM, historical punishment, ritual, power, submission, restraint, and dramatic human storytelling. The Platform provides access to fully synthetic, digitally generated video content and may also provide functionality allowing registered creators to upload, publish, distribute, and monetize their own eligible AI-generated content through the Platform.

2. Operator and Legal Framework
EpicBDSM is operated by an entity established within the European Union and provides the Platform in accordance with applicable laws of the Czech Republic and binding legislation of the European Union. The Operator is not an anonymous or concealed service provider and acts as an identifiable and transparent operator of an online intermediary service.

4. Applicable Law and Jurisdiction
These Terms of Service and any legal relationship arising out of or in connection with access to or use of the Platform shall be governed by and construed in accordance with the laws of the Czech Republic, with due regard to directly applicable provisions of European Union law. Unless mandatory consumer protection regulations provide otherwise, any disputes arising out of or in connection with these Terms of Service or the use of the Platform shall be subject to the jurisdiction of the competent courts of the Czech Republic.

5. Scope of These Terms
This Section defines the fundamental nature of the Platform, the identity of the Operator, and the legal framework under which the Platform operates. These provisions apply to all users of the Platform and form an integral part of these Terms of Service. In the event of any conflict between this Section and another provision of these Terms, this Section shall prevail to the extent permitted by applicable law.

6. Related Policies
By accepting these Terms of Service, whether through registration, accessing, purchasing, uploading, or otherwise using the Platform, the user expressly acknowledges and agrees that the Operator's Payment Policy, Refund Policy, Privacy Policy, Cookie Policy, and DMCA Disclaimer, as published on the Platform, form an integral part of these Terms of Service. These documents constitute a binding part of the contractual relationship between the user and the Operator, to the extent permitted by applicable law.

7. Changes to These Terms
These Terms of Service are effective as of 01 September 2026. The Operator may amend these Terms from time to time for justified reasons, including changes in applicable law, the Platform, technology, security requirements, or the services provided. Users will be informed of material changes in an appropriate manner through the Platform. Amendments take effect on the date specified in the updated Terms and shall not apply retroactively. Continued use of the Platform after the effective date constitutes acceptance of the amended Terms, without prejudice to mandatory consumer protection rights under Czech and European Union law.

1. Eligibility
The Platform is intended for adults aged 18 years or older. By accessing or using the Platform, the user confirms that they are at least 18 years old and legally permitted to access the Platform and its content in their jurisdiction. Certain areas or content may be subject to an age-verification prompt or other access restriction. Users who do not meet the applicable age requirements are strictly prohibited from accessing such content or using the Platform for purposes that are restricted to adults.

2. Voluntary Use
Use of the Platform is voluntary. Users are responsible for determining whether the nature of the Platform and its content is appropriate for them. By accessing adult-oriented content, the user acknowledges that they understand the nature of the Platform and voluntarily choose to access such content.

3. Registration Process
To register for a User Account, a person must provide a valid email address, create a nickname, and create a password. Registration itself is free of charge unless otherwise expressly stated on the Platform. Certain content, features, or services may require payment.

4. Account Credentials
Users are responsible for maintaining the accuracy of the email address provided during registration and for ensuring continuous access to that email account. The email address may be used for account verification, password recovery, security notifications, and other account-related communications. The Operator is not responsible for loss of account access resulting from an incorrect, inactive, or inaccessible email address. Users are solely responsible for safeguarding their passwords and other account credentials and for preventing unauthorized access to their accounts.

5. Account Security
Users shall take reasonable measures to protect their accounts, including using strong and unique passwords, maintaining the confidentiality of their credentials, and preventing unauthorized persons from accessing their accounts. Users must notify the Operator without undue delay if they reasonably suspect that their account has been compromised, accessed without authorization, or otherwise misused.

6. Account Suspension or Termination
The Operator may suspend, restrict, or permanently terminate a User Account where it reasonably determines that the user has violated these Terms of Service, applicable law, third-party rights, or the legitimate interests or security of the Platform. Such action may include cases involving fraudulent activity, unauthorized access, abuse of Platform functionality, prohibited Content, misleading information, failure to complete required verification, or repeated serious complaints. Where permitted by applicable law, suspension or termination may result in loss of access to the User Account and associated features or Content. Users whose accounts have been suspended or terminated shall not create replacement accounts or attempt to circumvent the suspension without the Operator's prior authorization. Mandatory consumer rights and other rights that cannot legally be excluded remain unaffected.

1. Definition of Content
For the purposes of these Terms, "Content" means videos, images, audio, text, descriptions, previews, thumbnails, metadata, graphics, and other creative or informational materials made available through the Platform. Content may be created by the Operator, by independent creators, or through other permitted sources.

2. AI-Generated and Synthetic Content
EpicBDSM is dedicated to digitally created and AI-generated video content. Content published by the Operator is fully synthetic and digitally generated. The Operator does not use real-world video footage or real people as the underlying subjects of its AI-generated video content. Characters appearing in Operator-created Content are fictional and digitally generated.

3. Historical and Creative Inspiration
Content may draw inspiration from ancient and medieval history, historical punishment, legends, rituals, mythology, power dynamics, submission, restraint, and dramatic human storytelling. The historical appearance or setting of Content does not necessarily mean that the Content represents an accurate historical reconstruction. The Platform may intentionally combine historical settings with contemporary visual elements, clothing, equipment, aesthetics, or environments. Some Content may also be situated entirely in modern settings.

4. Fictional Nature of Content
Unless expressly stated otherwise, Content should be understood as fictional and creatively interpreted material. Historical references, characters, settings, events, rituals, or forms of punishment may be adapted, altered, combined, or fictionalized for artistic purposes.

5. Adult-Oriented Content
Some Content may contain adult, sexual, erotic, BDSM-related, or otherwise mature themes. Other Content may focus primarily on power, punishment, submission, restraint, ritual, historical drama, or fictional storytelling without being primarily sexual in nature. Adult-oriented Content is intended exclusively for users aged 18 or older.

6. Prohibited Content
The Platform strictly prohibits Content involving or depicting child sexual abuse material (CSAM), sexualized depictions of minors, minors in sexual or BDSM contexts, non-consensual sexual deepfakes or sexual impersonations of real persons, zoophilia or sexual content involving animals, real-world sexual abuse or exploitation, content unlawfully depicting or exploiting real persons, content that facilitates, promotes, or meaningfully assists illegal activities, content that infringes third-party intellectual property, privacy, personality, or other legal rights, fraudulent or deceptive Content, or Content otherwise prohibited by applicable law or these Terms. The Operator may remove, restrict, or disable access to Content that violates these requirements or that creates a reasonable legal, safety, security, or platform-policy concern.

7. No Real-World Participants in Operator-Created Content
The Operator-created AI video content does not depict real persons as participants in the depicted events. Users should not interpret fictional AI-generated scenes as documentary evidence of real events, real acts, or real-world participation.

1. General User Rights
Users are entitled to access and use the Platform in accordance with these Terms of Service and applicable laws. Registered Users may access available features, purchase eligible Content, and, where enabled by the Platform, create, upload, publish, or monetize eligible Content. All rights granted to users under these Terms are non-exclusive, non-transferable, revocable, and limited to the intended use of the Platform. The Operator reserves the right to modify, restrict, or withdraw specific features or functionalities of the Platform at any time, provided that such changes comply with applicable law.

2. General User Obligations
Users shall use the Platform in compliance with these Terms, applicable laws and regulations, and the legitimate rights and interests of other users and third parties. Users shall not interfere with the operation, security, or integrity of the Platform and shall not attempt to circumvent technical, contractual, payment, access, or security limitations. Users shall not use the Platform for fraudulent, abusive, unlawful, or unauthorized purposes.

3. User-Generated Content
Users who upload, publish, or otherwise make Content available through the Platform are solely responsible for such Content. Users represent and warrant that they have all necessary rights, licenses, permissions, and legal authority required to upload, publish, distribute, and monetize their Content. User-Generated Content must comply with these Terms, applicable law, and the rights of third parties.

4. Requirements for User-Generated Content
Users shall not upload or publish Content that depicts or reproduces real persons without the necessary authorization, constitutes a non-consensual deepfake or impersonation, contains CSAM or sexualized depictions of minors, involves zoophilia, infringes copyrights, trademarks, personality rights, privacy rights, or other third-party rights, contains unlawful material or promotes illegal activities, falsely represents real events or persons in a manner that violates applicable law or third-party rights, or otherwise violates these Terms or applicable Platform policies.

5. User Responsibility for Content
Users bear full responsibility for Content they create, upload, publish, share, or otherwise make available through the Platform. The Operator does not assume ownership of User-Generated Content merely because it is uploaded to the Platform. Users acknowledge that they may be legally responsible for claims, damages, losses, or other consequences arising from their Content.

6. Reporting and Cooperation
The Platform may provide mechanisms for reporting Content, accounts, or activities suspected of violating these Terms or applicable law. Users shall use reporting mechanisms in good faith and shall not knowingly submit false, abusive, malicious, or harassing reports. Users agree to reasonably cooperate with the Operator in investigations concerning alleged violations, including by providing relevant information where reasonably requested. The Operator may review, restrict, disable, or remove reported Content or accounts while an investigation is ongoing or where action is otherwise justified.

7. Indemnification
To the fullest extent permitted by applicable law, users agree to indemnify and hold harmless the Operator, its affiliates, officers, employees, agents, and representatives from claims, liabilities, losses, damages, costs, and reasonable expenses arising from the user's unlawful conduct, violation of these Terms, or infringement of third-party rights. This includes claims arising from User-Generated Content, unauthorized use of the Platform, intellectual property violations, privacy or personality-rights violations, and misuse of Platform functionality. This provision shall not limit any rights that cannot legally be excluded under applicable consumer protection law.

1. Platform Operation and Maintenance
The Operator reserves the right to operate, maintain, update, modify, expand, restrict, or discontinue features of the Platform. This may include changes to the Platform's design, structure, functionality, technical limitations, account limits, pricing, Content availability, and usage policies. The Operator may temporarily suspend or restrict access for maintenance, upgrades, security measures, or technical improvements.

2. Content Moderation and Removal
The Operator may monitor, review, moderate, restrict, temporarily disable, or remove Content where reasonably necessary to enforce these Terms, comply with applicable law, protect users or third parties, protect the Platform, or respond to reports and complaints. The Operator does not guarantee continuous or proactive monitoring of all Content. Moderation measures may be taken proactively or following reports, complaints, legal requests, automated detection, or other relevant information.

3. Third-Party Services and AI Tools
The Platform may use or integrate third-party services, including AI generation technologies, hosting providers, payment processors, analytics services, authentication services, and other technical providers. Third-party services may be subject to separate terms, privacy policies, technical limitations, and fees. The Operator does not guarantee the uninterrupted availability, functionality, or performance of third-party services and shall not be responsible for failures caused exclusively by such third parties, subject to mandatory applicable law.

4. Pricing and Credits
Certain Content or Platform features may require the purchase of credits or other paid access. The applicable pricing, credit system, subscription arrangements, and payment conditions are described in the Platform's Pricing and Payment Policy sections. Credits may be subject to specific conditions regarding their use, expiration, refunds, transferability, or availability as specified by the Platform.

5. Creator Monetization
Where the Platform enables creator monetization, eligible creators may make approved Content available to other users in exchange for credits or other forms of Platform payment. Participation in creator monetization is subject to these Terms, applicable policies, technical requirements, and any additional creator-specific terms published by the Operator. The Operator reserves the right to reject, restrict, suspend, or remove creator Content or monetization functionality where reasonably necessary.

6. Data Management and Privacy
The Operator collects, processes, stores, and manages personal and non-personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR) and relevant Czech legislation. The processing of personal data is further described in the Platform's Privacy Policy. Users are responsible for providing accurate information where required for registration, payment, account management, or legal compliance.

7. Legal Compliance
The Operator undertakes to operate the Platform in accordance with applicable laws and regulations of the Czech Republic and the European Union. Users are responsible for ensuring that their access to and use of the Platform complies with the laws applicable to them in their jurisdiction. The Operator may cooperate with competent authorities and respond to lawful requests, investigations, court orders, or other legally binding requirements.

1. Ownership of the Platform
All intellectual property rights relating to the Platform, including its software, source code, design, graphics, interface, logos, trademarks, text, databases, and other proprietary materials, belong to the Operator or its licensors unless otherwise stated. Users receive no ownership rights in the Platform itself merely by using it.

2. Operator-Created Content
Unless otherwise expressly stated, Content created and published by the Operator remains the property of the Operator or the applicable rights holder. Users receive only the limited rights of access and use expressly granted by the Platform and these Terms.

3. Purchased Content
Purchase of access to Content does not transfer ownership or copyright in that Content to the user. Unless expressly permitted otherwise, purchased Content is licensed to the purchasing user for personal, non-commercial use and may not be redistributed, resold, publicly uploaded, sublicensed, or otherwise commercially exploited. Any additional usage rights expressly granted by the Operator shall prevail.

4. User-Generated Content
Subject to these Terms, intellectual property rights in User-Generated Content remain with the user or the applicable rights holder. By uploading or publishing Content, the user grants the Operator a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, distribute, technically modify, and otherwise use the Content to the extent reasonably necessary to operate, provide, promote, improve, secure, and develop the Platform. The license shall apply for as long as necessary for these purposes and shall survive removal of Content to the extent reasonably necessary for technical, legal, security, archival, dispute-resolution, or backup purposes.

5. User Representations Regarding Rights
By uploading Content, the user represents and warrants that they possess all rights, permissions, licenses, and consents necessary for the Operator to process and make the Content available through the Platform as contemplated by these Terms. Users shall not upload Content where doing so would violate the rights of another person or entity.

6. Prohibited Use of Intellectual Property
Users may not copy, reproduce, redistribute, resell, sublicense, reverse engineer, modify, publicly display, or commercially exploit the Platform or Content belonging to the Operator or other users except where expressly permitted by these Terms or applicable law. Unauthorized use may result in removal of Content, suspension or termination of the relevant account, and further legal action where appropriate.

7. Reporting Intellectual Property Violations
Suspected copyright, trademark, personality-rights, privacy, or other intellectual property violations may be reported to the Operator through the available reporting mechanisms or by contacting the Operator. Reports should contain sufficient information and supporting documentation to allow the Operator to assess the alleged infringement. The Operator may remove or disable access to allegedly infringing Content and may take additional measures where appropriate.

1. General Disclaimer
The Platform is provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law. The Operator does not guarantee that the Platform will always be available, uninterrupted, secure, error-free, or compatible with every device, browser, operating system, or network environment.

2. AI-Generated Content
Users acknowledge that AI-generated Content is synthetic and may contain visual, narrative, historical, anatomical, contextual, or other inaccuracies. The Operator does not guarantee that AI-generated Content accurately represents historical events, persons, cultures, practices, environments, or real-world circumstances. Content is provided for creative and entertainment purposes unless expressly stated otherwise.

3. No Endorsement
The publication or availability of Content does not constitute an endorsement, verification, or approval by the Operator of any historical claim, ideology, practice, person, event, or activity depicted in such Content. The Operator does not guarantee the accuracy, completeness, reliability, or suitability of User-Generated Content.

4. User Responsibility
Users are solely responsible for their use of the Platform, their accounts, transactions, uploaded Content, and interactions with other users. Users are responsible for determining whether Content is suitable for them and for complying with applicable laws in their jurisdiction.

5. Technical Limitations
The Platform may experience interruptions, delays, bugs, errors, network failures, server problems, maintenance periods, or third-party service failures. The Operator does not guarantee uninterrupted operation or permanent availability of any particular Content, feature, account functionality, or service.

6. Limitation of Liability
To the maximum extent permitted by applicable law, the Operator shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or related to the use or inability to use the Platform. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law, including mandatory consumer protection rights.

7. Adult and Sensitive Content
Users acknowledge that the Platform may contain mature, erotic, BDSM-related, historical punishment, violence-related, or otherwise sensitive fictional Content. Users access such Content voluntarily and are responsible for determining whether they wish to view it. The Operator shall not be responsible for a user's subjective reaction to fictional Content, subject always to rights and protections that cannot legally be excluded.

1. Paid Content
Certain Content and Platform features may be available only to users who have purchased the required credits or other paid access. The price applicable at the time of purchase will be displayed through the Platform before the transaction is completed.

2. Credits
Credits are digital units used within the Platform to obtain access to eligible paid Content or features. Credits do not constitute money, electronic money, a bank account, or a transferable financial instrument unless expressly required otherwise by applicable law. Credits may not be sold, transferred, exchanged, or redeemed for cash except where expressly required by law or stated by the Operator.

3. Payments
Payments are processed through the payment methods and third-party payment providers made available on the Platform. Users agree to provide accurate payment and billing information and authorize the applicable payment provider to process the transaction.

4. Refunds
Refunds are governed by the Platform's Refund Policy and applicable mandatory consumer protection law. Nothing in these Terms shall be interpreted as restricting statutory consumer rights that cannot legally be waived.

5. Digital Content and Consumer Rights
Where applicable law grants consumers specific rights concerning the supply of digital content or digital services, those rights remain unaffected. Where a user's statutory right to withdraw from a contract may be legally excluded following the user's express consent and acknowledgment where required by law, the applicable checkout process may contain the necessary information and consent mechanism.

1. Privacy
The Operator processes personal data in accordance with applicable data protection legislation, including the GDPR and relevant Czech legislation. Further information concerning the categories of data processed, purposes of processing, legal bases, retention periods, user rights, and third-party processors is provided in the Privacy Policy.

2. Cookies
The Platform may use cookies and similar technologies for essential functionality, security, preferences, analytics, and other permitted purposes. Further information is provided in the Cookie Policy and, where applicable, through the Platform's cookie consent mechanism.

1. Termination by the User
Users may stop using the Platform and may request deletion of their account subject to applicable law and the Platform's account procedures.

2. Termination by the Operator
The Operator may suspend or terminate access where necessary to enforce these Terms, comply with applicable law, protect the Platform or third parties, address security concerns, or prevent abuse.

3. Effect of Termination
Upon termination, the user's right to access restricted Platform features may cease immediately. Termination does not affect provisions which by their nature should survive termination, including provisions concerning intellectual property, liability, indemnification, dispute resolution, and outstanding legal obligations.

1. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect to the extent permitted by applicable law.

2. No Waiver
Failure by the Operator to enforce any provision of these Terms shall not constitute a waiver of the right to enforce that provision or any other provision in the future.

3. Entire Agreement
These Terms, together with the Payment Policy, Refund Policy, Privacy Policy, Cookie Policy, DMCA Disclaimer, and any additional terms expressly incorporated by reference, constitute the agreement governing the user's use of the Platform.

4. Language
The Platform may provide these Terms in multiple languages. In the event of discrepancies between language versions, the version designated by the Operator as authoritative shall prevail to the extent permitted by applicable law.
